The Canadian Association of Professional Employees (CAPE) joins the Public Service Alliance of Canada (PSAC) in celebrating yesterday’s Federal Court ruling to go ahead with full hearing into the Treasury Board’s decision to mandate employees return to the office three days a week.
In May, shortly after the updated return-to-office mandate was announced, PSAC asked the Federal Court for a judicial review. On Thursday, the judge shot down the employer’s attempt to quash the proceedings, stating that the government had not met the standard to dismiss the case, and the arguments merited a full hearing.
The Treasury Board will now be forced to justify its reasoning for pushing employees back to the office – a decision that was made with zero consultation with public sector unions and for which they have offered no evidence to explain their actions.
In the spring, CAPE and other federal public sector unions submitted unfair labour practice complaints and await rulings.
CAPE stands in solidarity with PSAC and looks forward to the next step in the legal process.
